Terms of Service

The rules for using Omertane: your account, fair play, virtual items and what we can expect from each other. Please read them before you create an account.

Who we are and what you accept

Omertane is a free online strategy game played in your browser. It is run by the operator named at the bottom of this page, with its registration number, address and contact email (“we”, “us”). These Terms of Service govern your use of the website, the game and everything inside them.

By creating an account or playing, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not accept them, do not create an account and do not use the service.

Who can play

You must be at least 16 years old to create an account, and you confirm this when you register. If you are under 18, please read these Terms together with a parent or guardian. If we learn that an account belongs to someone younger than 16, we will delete it.

You must be able to enter into a binding agreement where you live, and using the service must not be forbidden for you by law.

Your account

One account is enough: you lead one family in the city. Give us an email address you can access and a username that follows these Terms.

Keep your password secret and do not reuse one from another service. You are responsible for everything that happens through your account. Tell us at once if you think someone else has used it.

Your account is personal. Do not sell, trade or hand it over to someone else.

The service

Omertane is free to play and it keeps evolving: rules, numbers, content and features change over time. We may add, change, rebalance or remove anything, including mechanics, items, gold prices, buildings, troops and rewards, to keep the game fair, healthy and sustainable.

Significant changes are announced in the Dev logs on the website. The city is shared by all players, so a change usually applies to everybody at once.

The setting is fictional. The city, the families, the characters and the events do not depict real people or places, and the violence in the game is stylised strategy with no real-world meaning.

Gold and virtual items

Everything you gather or buy inside the game is a virtual item: resources, gold, items, boosters, speeders, Capos, fragments and so on. They exist only inside the game, have no cash value, cannot be exchanged for money and cannot be moved out of the game. You get a personal right to use them while your account is open; you do not own them.

Gold is the in-game premium currency, and you earn it by playing. At the time of writing, buying gold with real money is not possible: the “Buy gold” tab of the Black Market is a preview marked “Coming soon” and no payment can be made. If we introduce paid purchases, we will update these Terms first and show the price, the taxes and your right of withdrawal before you pay.

We do not refund or compensate virtual items lost through normal play, such as battle losses, spent items or expired boosters, nor after an account is closed for breaking these Terms.

We may correct or take back items, gold or resources obtained through a bug, an error or a breach of these Terms.

Fair play

Play against the other families, not against the game or the servers. You agree not to:

  • use bots, scripts, macros or any automation that plays or sends requests for you, or read the game in ways the normal interface does not allow;
  • exploit a bug or a mistake in the rules to gain an advantage: report it to us instead;
  • run several accounts in the game to help each other, farm resources, dodge attacks or bypass limits (an agreement between different real players, such as in a syndicate, is part of the game);
  • attack, overload, probe or try to break into our servers, accounts or other players, or bypass rate limits and protections;
  • impersonate staff or other people, or use names that mislead others;
  • harass, threaten, discriminate against or insult other players, or post hateful, sexual, illegal or private content in chats, announcements, names or avatars;
  • advertise, spam or promote other services in the game;
  • buy or sell accounts, items or progress for money or outside the game.

If you find a security problem, please report it through the contact address instead of using it.

Names, chat and avatars

Your username, family name, syndicate name and tag, chat messages, announcements and avatar are content you create. You are responsible for it, and you promise that you may use it and that it does not break the law or these Terms.

You give us a free, worldwide, non-exclusive licence to store and show this content to other players inside the service for as long as it exists, so the game can work. You keep your own rights over it.

Usernames, avatars and family details are visible to other players, and anyone can open your public profile. Do not put in them anything you do not want to be seen.

We may edit, hide or remove content, or ask you to change a name, if it breaks these Terms or the law.

What happens if the rules are broken

Depending on how serious and how repeated the problem is, we may warn you, mute you (you cannot write to other players for a set time), remove or rename content, take back items or advantages obtained unfairly, suspend your account for a set time or close it for good. Serious breaches, such as cheating, threats, attacks on the service or illegal content, can lead straight to a suspension or closure without a prior warning. Warnings, mutes and suspensions are decided and applied by members of the team, not by a program. The Rules explain each step and who can apply it.

Every warning, mute and suspension comes with a reason, which we send to you by email or in-game mail. If you think we made a mistake, you can appeal a suspension through Support in the category “Ban appeal” within 30 days, and a Game Administrator or the Community Manager will review it; a later appeal may still be reviewed.

Read the Rules

Availability and your progress

We work to keep the service running, but it is provided “as is” and “as available”. It can be interrupted for maintenance, updates, security or reasons outside our control, and bugs can happen.

We take reasonable care of your data, but we cannot guarantee that progress will never be lost or rolled back after a technical failure.

We may change, suspend or end a feature or a part of the game. If we ever plan to end the whole service, we will announce it on the website with reasonable notice.

Our rights

The game, its name and logo, code, artwork, sounds, texts and design belong to us or our licensors and are protected by copyright and other laws. We give you a personal, revocable, non-exclusive and non-transferable licence to use the service as intended, for your own entertainment.

You may not copy, resell, scrape, decompile, extract assets from or build commercial services on top of the game, except where the law expressly allows it.

Feedback and ideas you send us may be used by us without any obligation to you.

Closing your account

You can stop playing at any time. You can delete your account yourself in Settings, under “Delete account”. Deletion is permanent: your account, family and game data are removed, as the Privacy Policy explains. A family that stays away from the game for 365 days is deleted too, after warnings by email; your account stays.

We may suspend or close an account for the reasons in these Terms, and we will tell you the reason unless the law forbids it. Parts that by their nature should outlive the account, such as liability, our rights and the governing law, continue to apply.

Liability

Nothing in these Terms limits a liability that cannot be limited by law, including liability for death or personal injury, for fraud or intent, or the mandatory rights you have as a consumer.

Subject to that, and because the game is free, we are not liable for indirect or consequential loss, for loss of virtual items or progress, or for interruptions of the service. Our total liability to you for any claim related to the service is limited to what you paid us for it in the previous twelve months, which at present is nothing.

We are not responsible for what other players write or do, but you can report abuse to us.

Changes to these Terms

We may update these Terms, for example when the game or the law changes. The date at the top shows the last update. We will announce important changes in the Dev logs and, where the law requires it, ask you to accept them again.

If you do not agree with a new version, stop playing and delete your account. Continuing to use the service after a change takes effect means you accept the new version, as far as the law allows.

General

These Terms, the Rules and the Privacy Policy are the whole agreement between you and us about the service. If a part of them is invalid or cannot be enforced, the rest stays in force. If we do not enforce a right at once, we do not lose it.

The Terms are written in English, and English is the only language version. You may not transfer your rights or duties under them to someone else. We may transfer ours to another operator of the game, and we will tell you if we do.

Governing law and disputes

These Terms are governed by Romanian law, and the courts of Romania are competent to settle disputes, without taking away the rights that the mandatory consumer protection rules of your country of residence give you.

If you have a complaint, write to us first and we will try to solve it quickly and in good faith. As a consumer you can also contact the consumer protection authority of your country, an out-of-court dispute resolution body, or the courts.

In Romania the consumer protection authority is ANPC (Autoritatea Națională pentru Protecția Consumatorilor, Bulevardul Aviatorilor 72, Sector 1, Bucharest, anpc.ro, Consumer Phone 021 9551). It publishes information about out-of-court dispute resolution (SAL). The European online dispute resolution platform (ODR) was closed on 20 July 2025, so we do not link to it.

ANPC: alternative dispute resolution (SAL)
